Wills & Estate Planning

  • This is the most common type of Will and provides for a main executor and an alternative and then gives your estate to a specific person (i.e. your spouse) and then alternatives (i.e. your children).

  • A Testamentary Trust is part of your Will (i.e. it is not a separate document) and comes into effect upon your death. It allows you to provide for people without allowing them direct access to what has been given to them.

  • A POA can either be a General or Enduring power and they are very different documents for very different purposes. Both need you to have legal capacity to enter into them and only one will continue even when you lose capacity to make your own decisions. Let us help you figure out which one you need and when.

  • An AHD is also sometimes referred to as a living Will. It gives directions about your future health care (i.e. what procedures or medication you do (or don’t) want administered if you aren’t able to choose at the time) for times when you have lost capacity and cannot make those decisions for yourself. Initially prepared with you and your GP (as the GP needs to sign the ‘Doctors Certificate’). It can also include an Enduring Power of Attorney). You can then bring it to us and we then make sure everything is completed properly and then sign the form as your witness.

  • Did you know your superannuation and life insurances do not automatically go into your Estate (i.e. your Wills)? The Trustee of those funds have a Trust Deed which sets out how the funds should be paid. However we can assist in making sure you nominate who you want the funds to go to, making it binding on the Trustee.
